The Osun State chapter of the All Progressives Congress (APC) has rejected a Federal High Court judgment concerning the tenure elongation suit filed by local government chairmen elected under the party, insisting that it will challenge the ruling at the appellate level.

The party’s reaction followed Monday’s judgment, which held that the tenure of the APC-elected local government chairmen expired in October 2025.

In a statement issued by the party’s Director of Media and Information, Mogaji Kola Olabisi, the APC expressed dissatisfaction with the ruling and announced plans to seek redress at the Court of Appeal.

According to the party, a notice of appeal and a motion for stay of execution have already been filed, arguing that no enforcement action should proceed until the appellate court determines the matter.

The APC maintained that the legal battle over the tenure of the council chairmen is far from over, noting that related appeals arising from interlocutory decisions in the case are already before the Court of Appeal.

According to Olabisi, the appellate court sitting in Abuja had previously taken up matters connected to the dispute and adjourned proceedings until September 28, 2026.

The party argued that because the Court of Appeal is already handling aspects of the case and a motion for stay remains pending, the judgment delivered by Justice Adefunmilola Demi-Ajayi on June 15 should not have been issued at this stage.

The APC described the ruling as premature and insisted that the legal process should be allowed to run its full course before any final conclusions are drawn regarding the tenure of the affected officials.

Beyond challenging the judgment, the APC also questioned the validity of the local government election conducted by the Osun State Independent Electoral Commission (OSSIEC) on February 22, 2025.

The party argued that the election, which produced local government officials affiliated with the Peoples Democratic Party (PDP), as well as their swearing-in the following day, became invalid because the tenure of the APC chairmen and councillors had not yet expired.

According to the APC, its elected local government officials, who assumed office after the October 15, 2022 elections, remain constitutionally recognized office holders until October 2025.

The party therefore insisted that its chairmen and councillors would continue performing their duties across the councils pending the determination of the appeal.

The development sets the stage for another legal contest over local government administration in Osun State, with the final outcome now expected to depend on the decision of the Court of Appeal.
