Matt and Maria Raine, parents of the late Adam Raine, lodged the case in the Superior Court of California on Tuesday, accusing OpenAI of prioritizing profit over user safety when it released its GPT-4.0 model in 2024. The lawsuit represents the first legal action accusing the San Francisco-based company of wrongful death linked directly to its technology.

The teenager died in April, shortly after his interactions with the chatbot. His parents argue that OpenAI released ChatGPT to the public without adequate safeguards in place to prevent vulnerable individuals from harm, amounting to a violation of product safety regulations.

The lawsuit seeks unspecified financial compensation but, more importantly, aims to hold OpenAI accountable for what the family considers negligent deployment of an experimental technology.

“This tragedy was preventable,” the parents stated through their legal team. “Our son sought guidance, but what he received was a reinforcement of despair.”

OpenAI’s Response
