Justice Friday Ogazi of the Federal High Court in Lagos has ordered the National Drug Law Enforcement Agency (NDLEA) to produce detained Lagos social media influencer and businessman Afolabi Kazeem Michael, popularly known as KC Luxury, in court.

The order followed an ex parte application filed by Afolabi through his counsel, A. Labi-Lawal, SAN, challenging his continued detention after allegedly spending 14 days in NDLEA custody without being formally charged. The court also directed the anti-narcotics agency to respond within five days to the fundamental rights application and show cause why the applicant should not be released or granted bail.

Afolabi was allegedly arrested by NDLEA operatives on August 13, 2026, at the Murtala Muhammed International Airport, Lagos, while preparing to travel to Paris. His father, Eric Afolabi, who deposed to the supporting affidavit, alleged that his son had not been informed of the offence for which he was arrested or taken before a competent court.

The applicant further alleged that NDLEA operatives searched his residence in Banana Island, Lagos, without presenting a search warrant and allegedly found nothing incriminating. He also claimed that his iPhone 15 was seized and that officers demanded his password under threat of bodily harm.

Afolabi accused the agency of taking and circulating photographs and videos of him while in custody, arguing that the alleged publication violated his rights to dignity and privacy and portrayed him as a criminal before trial. He is seeking ₦100 million in damages over the alleged publication, ₦50 million for alleged unlawful arrest and detention, and ₦40 million over the alleged invasion of his privacy.

He is also asking the court to order the return of several seized items, including foreign currencies, luxury wristwatches, designer bags, an iPhone 15, a Lexus RX350 and a 2024 Toyota Hilux. He further raised concerns about his health, alleging that he suffers from severe asthma and requires urgent medical attention.

However, the NDLEA said Afolabi’s arrest followed an investigation into 184.50 kilogrammes of cocaine allegedly linked to an international drug trafficking network using Nigeria as a transit hub for shipments to the UK, Europe and Asia. The agency also said the investigation resulted in the seizure of foreign currencies and luxury items.

Justice Ogazi directed the NDLEA to produce Afolabi at the next hearing and adjourned the case until September 9, 2026, for hearing of the substantive application.
